Teilnahmebedingungen Gewinnspiel „3 x 2 Tickets“ für das DFB-Pokalspiel am 30.10.2024

A) Veranstalter und Gegenstand des Gewinnspiels

Die Veranstalterin des Gewinnspiels ist die Volkswagen AG, Berliner Ring 2, 38440 Wolfsburg
(nachfolgend: „Volkswagen“). Unter allen Teilnehmenden werden „3 x 2″ Tickets für das DFB- Pokalspiel am 30.10.2024 im Olympiastadion in Berlin (Hertha BSC gegen Heidenheim) verlost. Das Gewinnspiel wird über den Instagram- und Facebook Kanal des DRIVE. Volkswagen Group Forum (drive.berlin) angekündigt und verlost.

Dieses Gewinnspiel steht in keiner Verbindung zu META Ireland Limited, 4 Grand Canal Square, Dublin 2, Irland (nachfolgend „META“) und wird in keiner Weise von META gesponsert, unterstützt oder organisiert. Fragen, Kommentare oder Beschwerden in Zusammenhang mit diesem Gewinnspiel sind direkt an Volkswagen und nicht an META zu richten.

B) Teilnahme und Ausschluss

1. Das Gewinnspiel startet am 24.10.2024 um 10 Uhr und endet am 28.10.2023 um 15 Uhr.
2. Es werden insgesamt 3×2 Tickets an die Teilnehmenden verlost.
3. Die Teilnahme am Gewinnspiel erfolgt durch das Erfüllen folgender Bedingungen:
   Teilnehmende folgen dem Instagram-Kanal drive.berlin, kommentieren den Gewinnspielpost und verschicken per Mail an drive.info@volkswagen.de das Codewort #DFBPokalspiel_Hertha_ Heidenheim
4. Natural persons who are resident in the Federal Republic of Germany, at least 18 years old and have full legal capacity are eligible to participate. Participation in the competition is free of charge. Participation in the competition is not dependent on the purchase of goods or services or on the subscription to a newsletter.
5. The use of any kind of automated process to manipulate this competition is prohibited.
6. Jeder Teilnehmende darf nur einmal teilnehmen. Teilnehmende dürfen sich insbesondere nicht mit verschiedenen E-Mail-Adressen bei Instagram registrieren, um mehrfach am Gewinnspiel teilzunehmen.
7. Participation via competition clubs or other commercial service providers is excluded.
8. Volkswagen behält sich vor, Teilnehmende vom Gewinnspiel auszuschließen, wenn berechtigte Gründe vorliegen. Solche Gründe können unter anderem vorliegen bei Manipulationen im Zusammenhang mit dem Zugang oder der Durchführung des Gewinnspiels, bei Verstößen gegen diese Teilnahmebedingungen oder den Regelungen von Facebook oder bei falschen oder irreführenden persönlichen Angaben.
9. Mitarbeiter bzw. Mitarbeiterinnen und ihre Angehörigen des Volkswagen Konzerns, aller Marken und Gesellschaften sind von der Teilnahme ausgeschlossen.

C) Durchführung und Benachrichtigung

1. Unter allen Teilnehmenden werden 3 Gewinner bzw. Gewinnerinnen nach dem Zufallsprinzip ausgelost.
2. Die Auslosung und Benachrichtigungen der Gewinnenden finden am 28.10.2024 statt.
3. Insgesamt erhalten drei Gewinnende jeweils zwei Plätze für das DFB-Pokalspiel am 30.10.2024 im Berliner Olympiastadion (Hertha BSC gegen Heidenheim). Zur Annahme des Gewinns muss sich der Gewinnende innerhalb von 24 Stunden per Mail zurückmelden.
4. Meldet sich der Gewinnende nicht innerhalb von 24 Stunden bei Volkswagen zurück, verfällt der Gewinn und ein neuer Teilnehmender wird nach dem Zufallsprinzip ausgelost.
5. A cash payment of the prize is not possible. The entitlement to the prize is non-transferable.
6. Die Gewinnausgabe erfolgt via Mail über die Ausgabe von zwei eTickets.
7. Volkswagen behält sich das Recht vor, das Gewinnspiel aus wichtigen Gründen jederzeit abzubrechen. Dies kann beispielsweise der Fall sein, wenn die weitere Durchführung des Gewinnspiels durch Volkswagen aus technischen oder rechtlichen Gründen unzumutbar ist.

D) Verantwortlichkeit und Haftung von Volkswagen

Volkswagen is not responsible for the timeliness, completeness or accuracy of the transmission of participant data. In all other respects, Volkswagen shall be liable in accordance with the following provisions:

1. If Volkswagen has to pay for damage caused by slight negligence on the basis of the statutory provisions, Volkswagen shall have limited liability. In this case, liability only exists in the event of a breach of essential contractual obligations. This liability is also limited to the typical damage foreseeable at the time of conclusion of the contract.
2. The personal liability of Volkswagen's legal representatives, vicarious agents and employees for damages caused by them through slight negligence is excluded. For damages caused by them as a result of gross negligence, with the exception of their legal representatives and executives, the limitation of liability provided for Volkswagen in this section shall apply mutatis mutandis.
3. The limitations of liability in this section do not apply in the event of injury to life, limb or health. Irrespective of any fault on the part of Volkswagen, any liability in the event of fraudulent concealment of a defect, from the assumption of a guarantee or a procurement risk and under the Product Liability Act remains unaffected.

E) Schlussbestimmungen

1. The conditions of participation and the entire legal relationship between the participants and Volkswagen are subject exclusively to the law of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
2. The place of jurisdiction is – as far as permissible – the registered office of Volkswagen.
3. Legal recourse is excluded – to the extent permissible
4. The European Commission shall provide a platform for out-of-court online dispute resolution, which can be accessed under www.ec.europa.eu/consumers/odr On this platform, consumers can find a list of consumer arbitration bodies that can assist with an out-of-court settlement of disputes. Volkswagen is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
